Judge: Man not at fault in kidnap scheme
PHILADELPHIA, Dec 21, 2011 (UPI via COMTEX) –
A judge has dismissed charges against one of four people accused of locking up four mentally challenged adults in a Pennsylvania basement.
Witnesses said Eddie Ray Wright, 50, slept in the same basement where the victims were found Oct. 15 and was a victim, not an accomplice of alleged ringleader Linda Ann Weston, The Philadelphia Inquirer reported Wednesday.
“I cannot in good conscience hold Mr. Wright for trial,” Judge Patrick Dugan said Tuesday. “When he was in Philadelphia, he was one of the victims.”
At the two-day preliminary hearing, Beatrice Weston, Linda Weston’s niece, testified she was beaten, kept locked in closets and forced to prostitute herself, the Philadelphia Daily News reported.
Beatrice, 20, told the Common Pleas Court when they lived in Texas, Linda, 52, called men on a party line and would “have them come up [to Weston's house] and make me have sex with them.”

PHILADELPHIA, Dec. 21 (UPI) — A Pennsylvania judge has overturned an attempted-prostitution conviction for a woman accused of trying to trade sex for World Series tickets.
The Superior Court of Pennsylvania ruled Tuesday the third-degree misdemeanor conviction of Susan Finkelstein, 45, in March 2010 was invalid, the Philadelphia Daily News reported.
“The crime of attempt is subsumed in prostitution,” the court’s ruling reads, “and inasmuch as she was acquitted of prostitution, she may not be convicted of attempt.”
“Obviously, the vindication is a good feeling,” Finkelstein told the newspaper. “Although it is bittersweet just to come to a conclusion that we knew from the start, that I did not commit a crime.”
Finkelstein posted a Craigslist ad in fall 2009 reading: “Desperate Blonde Needs WS Tix: Diehard Phillies fan – gorgeous tall buxom blonde in desperate need of two World Series Tickets. Price negotiable — I’m the creative type! — Maybe we can help each other!”

On Tuesday, the Superior Court of Pennsylvania overturned an attempted prostitution conviction of former College of Liberal and Professional Studies student Susan Finkelstein, who allegedly offered sex for World Series tickets.
Finkelstein, a 45-year-old Philadelphia resident, was arrested on prostitution charges in 2009, when the Phillies played the New York Yankees for the World Series title.
In 2010, Finkelstein was tried in Bucks County Court where she was acquitted of prostitution charges but convicted of attempted prostitution.
The Superior Court ruled Tuesday that because Finkelstein was cleared of prostitution charges, she could not be convicted for the less-serious charge of attempted prostitution.

PHILADELPHIA — An appeals court has overturned the attempted prostitution conviction of a Philadelphia woman who was accused of offering sexual favors for World Series tickets.

Finkelstein acknowledged placing a “goofy” ad on Craigslist and hoping to use her “feminine wiles” to get tickets, but denied offering favors and said she wasn’t a prostitute.
At trial last year, Finkelstein was acquitted of prostitution but convicted of attempted prostitution.
The state Superior Court ruled Tuesday that since Finkelstein was cleared of the more serious prostitution count, she could not be convicted of attempt because the proof required to sustain both charges was the same. Also, the court noted, Finkelstein was not engaged in “sexual activity as a business” and said the crime of prostitution was not intended to “criminalize private illicit sexual relations.”

Wright’s attorney, Lou D’Onofrio, says his client is a victim. He said testimony showed that, “Eddie Wright was held chained in the basement, that he was held with the others, that Linda Weston held his Social Security card and … took his funds. And he, himself, was far from a conspirator and was one of the victims in this case.”
Herbert McDuffy, Weston’s attorney, sees a tough road ahead.
Asked what kind of a case he’ll mount, McDuffy said, “Every person has a right to a vigorous defense. Every person has a right to present evidence on their behalf to refute the charges the commonwealth presents, and that’s what we’re going to do.”
Charges were actually added in the case at the start of the hearing Monday. In addition to kidnapping and conspiracy, the suspects are also now facing assault, stalking and other counts.
Giving some of Tuesday’s most disturbing testimony of abuse and sex for money was Beatrice Weston, Linda Weston’s own niece.
She said her aunt forced her into prostitution.

But Dugan dismissed charges against Eddie Wright, citing testimony that Wright was sometimes held captive as well.
“I cannot in good conscience hold Mr. Wright for trial,” Dugan said after Wright’s attorney argued that his client was more a victim than a perpetrator.
Testifying earlier Tuesday, the second day of the preliminary hearing, Weston’s 20-year-old niece, Beatrice Weston, said her aunt had forced her into prostitution. She also alleged physical abuse and taunting at the hands of Weston and McIntosh.
Beatrice told the court she was forced to have sex with men her aunt brought home. She said one of the four adults who authorities say were imprisoned in the basement also was forced into prostitution.

Dugan ordered Weston, her boyfriend, Gregory Thomas, and her daughter, Jean McIntosh, held for trial on charges of kidnapping, assault, conspiracy, false imprisonment and other related counts for allegedly holding four people in the dank sub-basement.
“Like anybody who has charges dismissed and who maintained their innocence would be relieved, I’m sure he is,” said Louis D’Onofrio, Wright’s defense attorney, adding that Wright could be released within a day.
Beatrice Weston, the 20-year-old niece of Linda Weston, testified Tuesday that beginning when she was age 10 she was imprisoned, beaten and starved by her aunt and cousin, McIntosh, who also forced her into prostitution.

According to the Philadelphia Inquirer, a 45-year-old Pennsylvania woman who was convicted of trying to trade sex for Philadelphia Phillies World Series tickets in 2009 had her attempted prostitution conviction overturned on Tuesday by the Superior Court of Pennsylvania.
The woman was found guilty by a jury of a misdemeanor charge of attempted prostitution in 2010 after placing an online ad looking for Phillies World Series tickets, according to the Inquirer.
